RAD Brownbag Seminar: How Not to Be a War Criminal in Cyberspace 1 May, 2003
You are invited to a RAD Brownbag Seminar "How Not to Be a War Criminal in Cyberspace" When Featuring As America opens a new front in the war on terror, information operations will grow in complexity and ferocity. The two central legal questions regarding such military operations are: what actions in cyberspace are considered a "use of force" under international law?, and, if the war is already underway, How does the traditional law of armed conflict apply to these new means and methods of warfare? Thomas Wingfield will address these two questions. To answer the first, he will provide a detailed review of the UN Charter Paradigm, which governs the resort to force under international law, and explain the Schmitt analysis, the current state-of-the-art in legally evaluating information operations. To answer the second, he will return to first principles, and provide a clear explanation of the four customary principles of the law of war-discrimination, necessity, proportionality, and chivalry-with particular emphasis on how the apply to cyber warfare. This presentation, designed to educate operators, intelligence officers, mission planners, and decision makers with mission-approval authority, will provide a solid foundation for understanding the legality of military operations in cyberspace and the kinetic world. Thomas C. Wingfield is Counsel and Principal National Security Policy Analyst at ManTech Aegis Research Corporation in Falls Church, Virginia. A former Chair of the ABA's Committee on International Criminal Law, he is a Lecturer in Law at the Columbus Law School of the Catholic University of America. Mr. Wingfield is the author of The Law of Information Conflict: National Security Law in Cyberspace.
